These Terms and Conditions ("Terms") govern your access to and use of the RentKuna website and services ("Service") operated by RentKuna ("we," "us," or "our"), a rental property management service based in Louisville, Kentucky, United States. By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

1. Eligibility

You must be at least 18 years of age to use this Service or submit a rental application. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding agreement.

2. Account Registration

Certain features of the Service require you to create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that contain inaccurate information or violate these Terms.

3. Rental Applications

By submitting a rental application through the Service, you acknowledge and agree that:

• All information provided in your application is truthful, accurate, and complete
• You authorize us to verify the information you provide, including but not limited to employment, income, residential history, and references
• You authorize us to conduct background checks, credit checks, and criminal history checks as part of the application review process
• Each adult applicant (18 years or older) who will reside in the property must submit their own separate application
• Submission of an application does not guarantee approval or lease of any property
• We reserve the right to approve or deny any application at our sole discretion in accordance with applicable fair housing laws
• Application data, including photographs and uploaded documents, will be stored securely and used solely for the purpose of evaluating your application

4. Lease Terms

Our leases generally run 12 to 24 months. Specific lease terms, including rent amount, security deposit, and duration, will be discussed with our team and outlined in a separate lease agreement. These Terms do not constitute a lease agreement. Any lease agreement entered into between you and RentKuna will be governed by its own terms and conditions.

5. Rent Payments

If you become a tenant, the following payment terms apply unless otherwise specified in your lease agreement:

• Rent is due on the first (1st) day of each month
• An early payment discount may be applied for payments received on or before the first of the month, as specified in your lease
• A late fee will be assessed for payments not received by the sixth (6th) day of the month
• An additional daily penalty may be applied for each day rent remains unpaid after the late fee date
• Specific discount and fee amounts are defined in your individual lease agreement

6. Property Rules and Tenant Responsibilities

As a tenant, you agree to:

• Maintain the property in good condition and report any maintenance issues promptly
• Comply with all local, state, and federal laws and regulations
• Refrain from making unauthorized modifications to the property
• Abide by all community rules and guidelines
• Not permit any pets on the premises unless expressly authorized in writing
• Not engage in any illegal activity on the property
• Allow reasonable access for inspections, repairs, and maintenance with appropriate notice

7. Citations and Fines

RentKuna may issue citations or fines for violations of lease terms, property rules, or community guidelines. You will be notified of any citations through the Service or by other communication methods. You have the right to respond to any citation. Failure to resolve citations may affect your tenancy.

8. SMS and Communication

By providing your phone number and using the Service, you consent to receive communications from RentKuna, including but not limited to:

• Maintenance scheduling notifications
• Rent payment reminders
• Citation and violation notices
• Application status updates
• Property-related announcements

Message and data rates may apply. Message frequency varies. You may opt out of SMS communications at any time by texting STOP to our number or contacting us at 502-576-5605.

9. Photographs and Uploaded Content

You grant RentKuna a non-exclusive, royalty-free license to use, store, and process any photographs, documents, or other content you upload through the Service for the purposes of:

• Processing and evaluating rental applications
• Documenting property conditions
• Managing maintenance requests
• Record-keeping and compliance

You represent that you have the right to upload any content you submit and that such content does not infringe on the rights of any third party.

10. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of RentKuna. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without prior written consent.

11. Limitation of Liability

To the fullest extent permitted by applicable law, RentKuna shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, resulting from:

• Your access to or use of (or inability to access or use) the Service
• Any conduct or content of any third party on the Service
• Unauthorized access, use, or alteration of your transmissions or content
• Any errors or omissions in the Service's content or functionality

12. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Kentucky, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts located in Jefferson County, Kentucky.

14. Fair Housing

RentKuna is committed to compliance with all applicable federal, state, and local fair housing laws. We do not discriminate on the basis of race, color, religion, sex, national origin, disability, familial status, or any other characteristic protected by law.

15. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

16. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease.
